4. Limitation of Liability

To the maximum extent permitted by Romanian and applicable EU law, MARKKSON IT Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services, including but not limited to loss of profits, data, business opportunities, or goodwill. Our total liability for any claim arising from or related to our services shall not exceed the amount paid by you for the specific service giving rise to the claim during the twelve (12) months preceding the event. This limitation does not apply to damages caused by willful misconduct or gross negligence.

5. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Romania, without regard to conflict of law principles. For matters involving EU data protection, the General Data Protection Regulation (GDPR) and its Romanian implementation through Law No. 190/2018 shall apply. Any legal proceedings arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts in Bucharest, Romania.

6. Dispute Resolution

In the event of any dispute arising from these Terms or our services, both parties agree to first attempt resolution through good-faith negotiation. If a resolution cannot be reached within thirty (30) days, the dispute shall be submitted to mediation in accordance with Romanian mediation legislation (Law No. 192/2006). If mediation fails, either party may pursue resolution through the competent courts of Bucharest, Romania. For consumers within the European Union, this does not affect your right to bring proceedings before the courts in your country of residence.

7. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting the updated Terms on our website with a revised "Last updated" date. Your continued use of our website or services after changes are posted constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.
